Intellectual Property Ownership & Proprietary Algorithms

The Capter™ Audio Engine, including without limitation its discrete digital signal processing (DSP) architecture, CUDA/Tensor core acceleration pipelines, deep neural acoustic reconstruction models, analog tube saturation equations, Cython and C++ compiled machine-code binaries (including but not limited to .pyd, .dll, and standalone .exe binaries), user interface layouts, audio benchmark assets, trademarks, and branding, constitute the exclusive proprietary trade secrets and intellectual property of Capter Audio Technologies and its principal inventor and developer, Furkan Elmas.

Zero Reverse-Engineering, Decompilation & Anti-Tampering Prohibition

Under this Agreement, you are granted an executable license only. You explicitly agree that you shall NOT, directly or indirectly:

• Decompile, disassemble, reverse engineer, decrypt, unpack, or attempt to derive the human-readable source code from any Capter Audio software, compiled Cython machine code (.pyd), dynamic link libraries (.dll), or native Windows executables (.exe).
• Extract, harvest, copy, or duplicate the deep neural network weight tensors, parametric filter coefficients, or analog modeling tables embedded within the software.
• Modify, bypass, disable, circumvent, crack, or tamper with any cryptographic licensing checks, machine-binding mechanisms, or feature-lock verifications.
• Distribute, publish, mirror, or host unauthorized cracked, keygened, repackaged, or modified builds of Capter Audio software on any website, torrent tracker, forum, or cyberlocker.

Any violation of this section constitutes a willful and criminal infringement of international intellectual property rights and an explicit violation of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 1201 (Circumvention of Copyright Protection Systems), subjecting the violator to immediate civil damages (including statutory damages up to $150,000 per willful infringement), injunctive relief, and criminal prosecution.

Acquisition of an official Capter™ Studio Pro License ($59 USD one-time purchase via our verified Gumroad store at capteraudio.gumroad.com/l/capter-pro) or Capter™ Ultimate Flagship License ($249 USD via capteraudio.gumroad.com/l/capter-ultimate) grants the purchaser a perpetual, worldwide, non-exclusive, non-transferable license to execute and operate the software for professional studio audio production on authorized workstations.

Any technical reference data, laboratory benchmarks, and signal fidelity metrics published by Capter Audio Technologies are conducted strictly for scientific review, educational analysis, and DSP performance evaluation under the Fair Use doctrine codified in 17 U.S.C. § 107.

Performance Standards, Warranty Disclaimer & Liability Cap

Capter Audio Engine is engineered to the highest audio standards, guaranteeing sub-1.2ms latency, IEEE 754 64-bit floating-point dynamic headroom, and non-clipping analog soft-knee saturation. However, the software is provided “as is” without warranty against unforeseen operating system audio driver incompatibilities or host DAW buffer underruns.

In no event shall Capter Audio Technologies or its developer be liable for any consequential, incidental, or indirect damages arising from the use or inability to use the software, with aggregate liability strictly capped at the total amount paid by the licensee ($59 USD).
